Terms of Service

1. Eligibility & Account

You must be at least 18 years old and able to form a binding contract under applicable law. You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at support@aeomedia.ai of any unauthorized access.

2. The Services

AEO Media provides Answer Engine Optimization (AEO) services designed to improve how AI search engines (including ChatGPT, Gemini, Claude, and Perplexity) describe and recommend your brand. Deliverables vary by plan and may include audits, citation building, content optimization, schema and entity setup, monitoring, and reporting. The exact scope of each engagement is described in your selected plan and in any statement of work or onboarding document provided after signup.

AI search rankings depend on factors outside our control, including third-party model behavior, indexing schedules, and competitor activity. We do not guarantee specific rankings, mentions, traffic, revenue, or business outcomes. We commit to performing the Services with reasonable skill and care.

3. Subscriptions, Billing & Auto-Renewal

Subscriptions are billed monthly in advance at the price displayed at checkout. Plans currently range from $39 to $479 per month. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis on each renewal date until you cancel.

If a payment fails, we may retry the charge and may suspend the Services until payment succeeds. We will notify you of failed payments by email. If you upgrade or downgrade your plan mid-cycle, charges may be prorated. All fees are exclusive of applicable taxes, which you are responsible for.

We may change pricing on a going-forward basis with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new price.

4. Cancellation

You may cancel your subscription at any time. Cancellation can be completed from your account dashboard or by emailing support@aeomedia.ai. Cancellation stops future renewals and takes effect at the end of the current billing period. You retain access to the Services through the end of the period you have already paid for. Cancellation does not, by itself, trigger a refund — see Section 5 for refund terms.

5. 30-Day Refund Guarantee

We offer a 30-day refund guarantee on every paid subscription. If you are not satisfied for any reason, contact us at billing@aeomedia.ai within 30 days of a charge and we will refund that charge in full. Refunds are issued to the original payment method, typically within 5–10 business days depending on your bank or card issuer.

The 30-day guarantee applies to the most recent payment. Earlier payments outside the 30-day window are non-refundable. We reserve the right to deny a refund where we reasonably believe the guarantee is being abused (for example, repeated subscribe-refund cycles or use of the Services in violation of these Terms). 6. Chargebacks & Disputes

Because we offer a no-questions-asked 30-day refund and easy self-service cancellation, you agree to contact us at billing@aeomedia.ai before initiating a chargeback or payment dispute with your bank or card issuer. Chargebacks filed without first contacting us — for charges that have been delivered as described — may be contested with evidence of account access, service delivery, login records, and acceptance of these Terms. If a chargeback is decided in our favor, you authorize us to re-charge the original amount plus any associated fees.

7. Free Trials & Promotional Offers

If we offer a free trial or promotional discount, the terms (length, discount amount, eligibility) are stated at the point of sign-up and form part of these Terms. Unless cancelled before the trial ends, your subscription will automatically begin and your payment method will be charged at the regular rate. Promotional pricing applies only for the period stated and reverts to standard pricing thereafter.

8. Acceptable Use

You agree not to use the Services to:

• violate any law, regulation, or third-party right;
• promote brands, products, or content that are illegal, fraudulent, hateful, sexually exploitative, or that infringe intellectual property;
• attempt to interfere with, reverse engineer, scrape, or overburden the Services or our infrastructure;
• upload malware, automate abuse, or impersonate any person or entity;
• resell, sublicense, or repackage the Services without our prior written permission.

We may suspend or terminate accounts that violate this section without refund.

9. Customer Content & Licenses

You retain ownership of any brand assets, content, websites, or materials you provide to us ("Customer Content"). You grant AEO Media a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Customer Content solely as necessary to provide the Services. You represent that you have the rights necessary to grant this license.

Deliverables we produce for you (audits, reports, optimization files, recommendations) are licensed to you for your internal business use upon payment in full. We retain ownership of underlying methodologies, tools, templates, and know-how.

10. Confidentiality

Each party will protect the other's non-public information disclosed under these Terms with the same care it uses for its own confidential information (and in any event no less than reasonable care), and will not use it except to perform these Terms. Confidentiality obligations do not apply to information that is public, independently developed, or required to be disclosed by law.

11. Third-Party Services

The Services may interact with or rely on third-party platforms (including Stripe for payment processing and AI search providers). Your use of those platforms is subject to their own terms. We are not responsible for the availability or behavior of third-party services.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE SPECIFIC RESULTS, RANKINGS, MENTIONS, OR REVENUE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless AEO Media, its affiliates, officers, employees, and contractors from any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your Customer Content, (b) your use of the Services in violation of these Terms or applicable law, or (c) your infringement or violation of any third-party right.

15. Termination

You may terminate at any time as described in Section 4. We may suspend or terminate your access to the Services if you breach these Terms, fail to pay fees when due, or use the Services in a way that creates legal or operational risk. Upon termination, provisions that by their nature should survive (including ownership, confidentiality, disclaimers, limitations of liability, and dispute resolution) will survive.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws principles. The parties will first attempt in good faith to resolve any dispute informally by emailing support@aeomedia.ai. Any unresolved dispute will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and each party consents to personal jurisdiction and venue there.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or through the Services at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

18. Miscellaneous

These Terms (together with the Privacy Policy and Refund Policy) are the entire agreement between you and AEO Media. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
